Divorce: Lucy Curtis Alderman v Martin VB Alderman, Williams County, OH - 1878

From the Williams County Civil and Criminal Court (Journal 9 p494, Roll 32 case number 445 - 17 Apr 1878) there was a divorce which dealt with a cruel Alderman.  Lucy Curtis (b1852 NY, daughter of James and Ellen Curtis, natives of Ireland, lived in Verona, Oneida Co, NY (1850), and Rome, Oneida Co, NY (1855-1870).  The 18 year-old school teacher married Martin Alderman in Onondaga Co, NY on 4 July 1870. 

 

Martin (b Nov 1846 NY - 23 Mar 1910 Fayetteville, Onondaga Co, NY) was the son of John and Laura (Potter) Alderman.  By the 1875 NY State census for Manlius, Onondaga Co, the Aldermans were enumerated as Martin 28 NY laborer, Lucy 22 NY, Horace 4 NY, and Minnie 1 NY along with father John Alderman 56 NY.  

 

Lucy Alderman appeared in court, a resident of Ohio for at least one year, in 1878, requesting a divorce.  She stated that on 1 Aug 1871 Martin violently beat her; on 1 Nov 1876 Martin was extremely cruel to her and willfully deserted her on that date.  She called into court the following people to substantiate her claims: Alex Gilbert, Lewis Grosvenour, Sarah J. Alderman, and Jenny Kinney. The couple had two children - Horace J (May 1872 MI - 2 Jan 1944, Toledo, Lucas Co, OH, m Iona Pitts, 1891) and Minnie M (25 Nov 1874 NY - 25 Nov 1948. Antwerp, Paulding Co, OH; m Andrew Ruger).   The divorce was granted and Lucy almost disappeared from this story, but a letter of permission to marry was attached to her daughter’s marriage license: “I am willing to have my daughter marry.  Her father hasn’t done anything for her since she was two.  I am divorced.  Signed......Lucy J. Manning.”

 

Martin married Sarah J Swingham (1845 PA) on 18 Apr 1880 in Waldron, Hillsdale Co, MI; both were residents of Fulton Co, OH.  Via the 1880 Orleans, Ionia Co, MI federal census, one finds this family as Martin 33 NY farmer, Sarah J 35 NY, Horace J 9 MI, and Minnie 6 NY.  Note - there is an error in Lucy’s aforesaid letter of marriage permission as Minnie is clearly living with her father at age of six. Two daughters have been discovered as issue of Martin and Sarah - Maryett (31 Dec 1875 - 10 Aug 1876, Amboy, Hillsdale Co, MI, and Amy B (Dec 1888, MI - . Note that Maryett was born to Sarah Alderman several years before Lucy applied for a divorce.  

 

According to the Syracuse Evening Herald (Syracuse, NY), 24 May 1893, p4 c3 Martin Alderman of Ohio while visiting his sister, Mrs Julia Hooghkirk, stole her jewels and sold them to buy a revolver.  He was sent to the NY State Penitentiary for 60 days and the revolver was confiscated.  By 25 Dec 1896 Martin and his wife were destitute and became inmates of the Onondaga Co Poor House. The couple is found living in Dewitt, Onondaga Co, NY through the 1900 federal census - Martin 53 NY and wife Harriett 53 NY; therefore sometime between 1880 and 1900 Martin has married again.  The Superintendent of the Municipal Lodging aka Poor House found work for Martin and his wife on a farm nearby near Fayetteville, NY (Post Standard, Syracuse, NY), Monday, 17 June 1901, p7 1. The 1905 Onondaga Co, NY state census showed the couple still living in the poor house as inmates. The Poor House records do show that Harriet was born in Germany, had very little education, and was a domestic.

 

The Post-Standard (Syracuse, NY), Wednesday, 22 March 1910 contained a meager obit for Martin Alderman, survived by widow and a son and daughter.  He was buried beside his mother in the Fayetteville Cemetery.  Nothing is known of his widow.

Ordered to Leave Home

So Says Mrs. Bertha M Gause in Petition for Divorce from Bert D Gause

Charging among other things, that her husband, Bert D Gause, ordered her to leave home before the next afternoon, or that he would hire a dray (wagon) and move her and her clothing, Mrs. Bertha M Gause, prays for a legal separation of the marital ties that now bind her to an alleged recreant spouse.

In the petition filed in common pleas court, and sworn to by her, Mrs. Gause charges that her husband has been guilty of extreme cruelty and gross neglect of duty.  She says that for two years Mr. Gause has refused to give her any affection or attention.  That he refused her money, unless she would tell him for what purpose she wished to use it.  Mrs. Gause also says that the defendant would take his meals at a hotel and that on several occasions from the slightest provocation, cursed her before large crowds of young people.

Mrs. Gause says her husband has property in Montpelier valued at $2,000.  She asks for a divorce, suitable alimony, and that she be restored to her maiden name of Bertha M Daughton.  DA Websterr of Montpelier is her attorney.  Mr. Gause operates a pool room in that town.  The couple was married at St Joe, MI on September 27, 1903.

Bert D Gause (31 July 1878, Roan, Wabash Co, IN – 7 December 1960. Elkhart, Elkhart Co, IN), was the son of George Gause and Kate Corder; he is buried in Rice Cemetery, Elkhart, Elkhart Co, IN.

Bertha M Daughton/Doughton (13 December 1884, Montpelier, Williams Co, OH – 24 February 1979, Toledo, Lucas Co, OH), was the daughter of Cassius/Caius Doughton and Emma S Wingert.

As stated in the newspaper article the couple was married on 27 September 1903 in St Joseph Co, MI.

Other marriages included

Bert D Gause married Mae A Deal , daughter of Silas Grier on 24 December 1920 in Elkhart Co, IN; Mae had been divorce twice before, once in 1911 and the other shortly before her marriage to Bert.  The couple had a daughter, Emeline, born 1931.

Bertha married William M Lane on 14 May 1908 in Lucas Co, OH and divorced by the 1910 federal census. She married Daniel J Rehklau in Lucas Co, OH on 4 April 1915.

From South Bend and Indianapolis, IN newspapers , starting on 9 January 1915 -5 March 1915 one learns that Bert was a naughty boy.  Melvin Long, a tramp, was arrested for stealing $200 worth of cigars from freight car on route from Florida to Chicago.  William Long, his brother, a Lake Shore trainman, is charged with receiving stolen goods.  Bert D Gauze, poolroom owner, is accused of buying some stolen cigars and Clyde Deller, laborer, is held under investigation in Elkhart, IN.

Bert had to pay a cash bond on $500 for his appearance in court.  It has been said he purchased stolen items from a gang of loafers about his place.  Bert was convicted of receiving stolen goods and fined $50 plus served 30 days in jail.

In South Bend and Indianapolis newspapers of 1916 Bert placed several ads in newspapers – he has a first class mail order or hardware specialty, full of merit, dies ready for manufacturing, price $5,00.

One also learns that Bert has a brother, William who was the owner of William Gause Shows and Italian Band (carnival) that toured principal cities in US, plus in 1909 had a first class restaurant in Peru, IN.

And Now John Crisman Seeks a Third Divorce From Her For Desertion

John Crisman, a horse dealer of this city, has married the same woman three times.  Crisman was first married to Pauline Bodenbaugh [Bodenburg] at Bryan, OH, 30 years ago.  Five years later he obtained a divorce on the grounds of abandonment.  He came to Oklahoma from Chicago in 1889.  His former wife followed him and they were married again.  A year later a second divorce was obtained by Crisman on the grounds of abandonment, and Crisman came to this city.  His wife followed him again, and old troubles were buried for a third time and Crisman and wife were married.  One year ago Mrs. Crisman left her husband’s home and today her husband filed a third divorce suit.  Crisman is a Grand Army man and has a son fighting in the United States Army in the Philippines – Perry, O> T> special to Chicago Inter Ocean.

Perry, OK, T., December 12 – John Crisman, formerly of Bryan, Williams County, Ohio, filed his third suit for divorce from his wife, Pauline Crisman.  They have been married three times and now Crisman seeks a third divorce.  The first marriage was in Bryan, OH, where the first divorce was obtained.  The second marriage and divorce were at Guthrie, OK. T and the third marriage took place here, and now Crisman is seeking his third divorce.  He alleges abandonment.  Crisman is a prominent GAR man, and runs a livery stable here.

The timeline from the first article is

1889 he came from Chicago to Oklahoma

1889-1890 she follows him, they marry, then divorce

1890ish – he moves to Perry OK, she follows him, they marry

Surprise #1

Pauline Bodenburg  Crisman v John C Crisman

Pauline claimed that on 13 April 1892 John was guilty of extreme cruelty at the residence of his father where they lived.  He carried on a terrible assault, choking and beating her causing blood to flow from her nostrils and putting her in fear for her life.  On the day following she returned to the residence and she was driven away whereby John refused to live with her.  He had 20 acres of land valued at $1,000.  Pauline wanted a divorce, reasonable alimony, and restoration of her maiden name.  They have three children, but there was no mention in the divorce papers about Pauline wanting sole custody or any remarks referring to these children.  The court found John guilty of extreme cruelty and ordered him to pay Pauline $300 in alimony, setting a payment schedule and placing a lien on his property if he did not pay her.

Violet (24 May 1909, Montpelier, Wms Co, OH – 26 July 1971, Adrian, Lenawee Co, MI); bur at Oakwood Cem, Adrian, Lenawee Co, MI.  She was the daughter of Bert Dick and Laura Baker.

This couple had two sons, Jerry Verden and Lowell.  Howard had a son, William from his first wife.

In 1934 and 1936 Howard was listed as a tree surgeon in the city directories of Adrian, MI.

Samuel wants custody of minor children; they have three children.  Looked through mid March 1912 and did not find granting of divorce.

Cal Patee and Mrs. Bertha Figgins Boltosser were arraigned last Friday.  She is the wife of Charles Baltosser, a carpenter from Montpelier.  Patee is a brakeman on the Wabash RR and a resident of Montpelier until he left for Detroit recently.  On Friday morning Baltosser returned home expectantly to get some tools and found the doors of the house locked.  He was eventually admitted by his wife and found Patee in their sleeping room in a clothes closet.  They were arrested and charged with adultery.  She is the daughter of Emmanuel Figgins of near West Unity and was married in September of 1900.  They have a seven year old son.  Pattee has a wife and two children living in Detroit.  Baltosser plans to sue for divorce.

Sometimes a newspaper notice of a divorce is not as accurate as one would like.  This is such a case.

A genealogy friend sent me the divorce notice for this couple. I checked several newspaper issues for a result of divorce but did not find any more information on the court news.  Here are the inaccurate details when comparing the newspaper account with other records:
1.  The record of marriage in the newspaper is incorrect.
2.  The maiden name of the plaintiff was not Strock but Dick.
3.  There was a child born to the couple.  In fact she has a son, Donald L Strock, b3 May 1903 whose father was listed as Walter L Strock.  There is a possibility that Martha asked for the divorce to be dismissed, got back together with Walter, and later filed after her son was born, approximately two years later.

Paul Jones, whose Post Office address and residence is to plaintiff unknown, take notice that on 2 November 1891, Minnie Jones filed her petition in the clerks court of the Court of Common Pleas in Williams Co, OH case #2927 charging that defendant, J Paul Jones with continuous and willful absence from said plaintiff for more than 3 years.  The object and prayer of said petition is for the procurement of a divorce by said plaintiff from said defendant on said grounds and for the custody of one minor child of said plaintiff and said defendant and for alimony.  Said defendant is required to answer or to demur to said petition on or before 6 weeks from and after the 5^th day of November 1891.Minnie Jones, Plaintiff

Minnie Jones v J. Paul Jones (Roll 51 case number 2927 - 1891/93)

The couple was married in Hillsdale Co, MI in July 1882.  Minnie said that her husband had been absent for three years and was guilty of gross neglect of duty.  She wanted custody of their daughter, Stella Jones, and $500 in alimony.  This action was filed on 2 November 1891 and appears to have been finalized by the court during the April 1892 term.  Minnie stated that J. Paul had left her in June 1884 and that he was lazy and indolent; he gave her no support for the child, yet he was wealthy as he was heir to his father’s estate.  Minnie had no property.  The court granted all her requests.

Starting with this information, I found the following:

Minnie B. St John married Jefferson P Jones in Amboy Twp, Hillsdale Co, MI on 23 July 1882; he was 21, a farmer with residence in Hillsdale, MI; she was 20 with residence in Williams Co, OH; they were both born in Ohio.

The Groom

Jefferson P Jones married Ida May Hall in Lickley Corners, Hillsdale Co, MI on 21 October 1894.  The license stated that they both lived in Prattville, MI and neither had been married before.  He was 30, a barber, born in West Unity, OH to SS Jones and Margaret Dunscomb; she was 22, born in Bordina, NY, the daughter of James Hall and Mary A Evans.

Jefferson Paul Jones, born 3 October 1861 in West Unity, Williams Co, OH, son of Samuel Jones, died on 10 September 1940 in Jackson, Jackson Co, MI; he was buried in Woodland Cem, Jackson Co, MI

The Bride

Minnie Jones married Alfred H Reader in Williams Co, OH on 26 March 1892.  Minnie was the daughter of Ward St John and Catherine Yost.

In Fayette, Hilldale Co, MI Alfred H Reader died on 12 April 1905 and was buried in the Osbourne Cemetery.

Minnie Reader married Albert L Fitton on 10 January 1907 in Hillsdale Co, MI.

In 1910 Jackson Co, MI we find Fitton, Albert L divorced; so far I’ve not discovered Minnie, but in 1910 there is a Royal Reader 15 MI living as inmate of Lansing, MI Industrial School for Boys

On 24 March 1916 in Hillsdale Co, OH Minnie Fitton married Andrew Allen Smith.

Loren E Case, son of Job B Case and Estella Smith married Emma J Shear, daughter of David Bice and Rilla Snowden on 5 April 1900 in Williams Co, OH (Marriage V8 p134)

Loren was 37 on 8 Sept 1899; he was married once before.  She was born and a resident of Shiawassee, MI where he was a carpenter.

The Bride:

Emma J Shear was 21 on 8 Dec 1899; she was previously married and divorced to Shear.  She lived in Pioneer, OH.
