I began research only with these two newspaper articles and then located other sources that helped to bring a genealogical detailing for this couple.

One of three divorce cases

Parties of third suit have lived together as man and wife for over thirty years.

Now the better half asks to be forever separated from her husband, Aaron Benn, charging him with gross neglect of duty.  Lucinda Benn in the petition filed by her attorney, Charles E Scott, says that for more than seven years her husband has willfully failed to provide her with necessary support, comfort, and care and sustenance.  During that time plaintiff says she had to support herself and that for four years she washed and ironed, sometimes as many as seven washings a week.  Years ago, while living at Melbern, she cared for the defendant’s parents.  She says that for twenty years solicitude given his father, and for sixteen years during which she faithfully cared for his mother, she received no compensation.  At the time of their marriage he had three children by a former wife, Mrs. Benn raised them to manhood and womanhood.

She further alleges that for the last ten years as frequently as once a month he has called her indecent names.  On July 18 at their home in Bryan the defendant in a fit of madness said to the plaintiff, ‘you keep your mouth shut or I’ll knock your teeth down your throat.”  This conduct on his part having continued for so many years plaintiff says that she became afraid of him and now fears him.  She therefore asks that she be granted a divorce and that property now in her name be decreed upon her.  She owns lots Nos 80 and 82 in Allen’s Addition to Bryan, besides wearing apparel and household goods.  They have no children.

She Liked Other Men

In the answer of Aaron Benn to the petition for divorce filed by his wife Lucinda, several weeks ago, he charges that during their married life he treated her as his faithful wife, despite the knowledge he had that Mrs. Benn had on numerous occasions been in company with and associated with other men.  He admits that they were married about thirty years ago, that they have no living children, that plaintiff separated from him on July 28 but says that she left him without just cause or provocation.  He also admits that Mrs. Benn is correct in her statement regarding his father and mother and three children who were at times members of their household.  He differs from Mrs. Benn in her statements regarding the purchase of the lots described in her petition.  Although the property is in her name Benn claims that he paid a part of the purchase price.

He denies each and every other averment and allegation contained in her petition and asks that it be dismissed.  CL Newcomer is his attorney.

Lucinda Benn v Aaron Benn, divorce decree as prayed for.  Title of plaintiff quitted in property in real estate.  Plaintiff gets household goods save sufficient to furnish bedroom for the defendant.  Horse and buggy to be sold, costs paid thereon and balance of proceeds thereof to be divided between the parties.

Lucinda Shade, daughter of Henry and Mary Wilhelm Shade, was born on 29 Aug 1849 in Montgomery Co, OH.  She died on 28 July 1941 in Bryan, Pulaski Twp, Williams Co, OH; she was buried in Brown Cem, Center Twp, Williams Co, OH.

At the age of 91 Lucinda Benn died at the home of her brother, John Shade, on Monday.  She was buried in Brown Cemetery.

Sensitive Subject - Insanity in Williams County, Ohio - Schnurr

A day after I posted this, I found more information plus a correction to the online death record of Ursula Schnur, so look for add-ons in bold.

Thank goodness for old newspapers being available for public research.  Here is an example of an insanity hearing that was mentioned in a Williams Co, OH newspaper, printed close to 106 years ago; however upon closer research one finds an error in the account.

Bryan Democrat, 1 June 1905

“An inquest as to the sanity of Ursula Schnurr, a daughter of John Schnurr who lives one mile south of Stryker, was held before Judge Schrider last Monday.  After hearing the testimony of three witnesses – Geo Buehrer, Charles F Mignin, and John Schnurr, she was found to be a fit subject to be sent to the hospital to undergo treatment.  She was taken to the Toledo state hospital for insane on Wednesday by Sheriff Ames.”

Tie this in with the following information:

Ursula Schnur - Williams Co, OH Probate case number 4698 misc – 18 May 1905 (i.e. one will be unable to see the case until a change, if ever, in judicial personnel takes place in Williams County, OH)

Tie this to the Ohio Death Records online:

Ursula Schnurr died on 26 July 1915 in Toledo, Lucas Co, OH.  According to her online death certificate she was married, 58 years old (born 1857), and buried in the Evansport Cemetery.

Note is appears that Ursula remained as inmate of the Toledo State Hospital for Insanity for ten years before her death. Note that according to the Springfield Twp Cemeteries, WCGS, both Ursula A Schnur (1856-1915) and husband John Schnur (1854-1924) are buried in the Mt. Zion Cemetery.  Ursula's father, Martin Buehrer, a cooper from Luzern, Switzerland, is also buried in that cemetery with the dates of 12 Apr 1823 - 3 July 1891.  There is also more data on the Buehrer family in The Ancestry and History of the Buehrer Families, James D. Buehrer, 1916, p37.

Now we have a better picture of who Ursula Schnurr really was – NOT the daughter of John Schnurr, but his wife.

From other sources I have been able to piece together a little bit of information regarding the husband, John, and his wife, Ursula Buehrer Schnurr.

Newspaper Obit in Williams County, OH - Allomong

Those old newspapers are loaded with tidbits of life and death in Williams Co, OH.  It is always amazing to me how blunt some comments were back then.  I must admit when I read this example of “insensitivity” I felt sorry for the parents to have this published about their child.

John Allamong’s son Frank, known as the “fat boy” died Thursday.  He was 13 years old and weighed 280 pounds.

Here's a little bit of info on Frank's lineage:

Franklin C. Allomong (1872 Williams Co, OH – 28 Feb 1884 Florence Twp, Williams Co, OH @12Y 6M; burial in Leggetts Cem) Note the Florence Twp, Williams Co, OH Cemetery Records, WCGS, 1995 shows the death date as 28 Feb 1881; it’s very easy to mistake a 1 for a 4 or 7, especially on old tombstones.

Frank’s parents were:

John Allomong (Sept 1821 pos Armstrong Co, PA – 21 May 1905, Edon, Florence Twp, Williams Co, OH @83Y 6M 28D; burial in Leggetts Cem); son of John and Julianna Rarick Allomong.

Note an online source states that John was “a large man, over 6 feet tall and weighing well over 200 pounds.”

John Alloway died at the home of his son Charles, Sunday.  He had been in poor health for several months and was one of the oldest farmers living near Edon.

Possible Update on Beaty Divorce Action

Johannah Van Sickles (?) Beaty v William Beaty (Journal 12 p165 - 18 Dec 1883; Roll 39 case number 1168 - 2 July 1883)

The divorce action previously posted may have more information.  The court action documents contain a "soiled document" warning as the microfilm copy of the roll has light spots on it where the day and month of the marriage are recorded but did not show up on the microfilm; upon reexamination of the document I still see the year as 1881, but that may be a misrepresentation of the actual marriage date. The clerk may have made a mistake or the filer (Johannah) may have had a memory lapse.  Anyway, it is possible that the Johannah Beaty mentioned is Anna Van Sickles who married William Beaty in Williams Co, OH on 8 July 1880. If this is indeed the case, then the couple married in 1880, the divorce action was filed in 1883 with a dismissal.  This could also mean that the action was refiled in another venue and a divorce was later granted.  I found the 1900 federal census for William Beaty to contain the info that he was divorced.  Again this may be a result of this divorce or another.  At this point the detailing is sketchy.

To recap, this is what was found in the Williams Co, OH Civil and Criminal Court Records with additional information on Ionna/Johannah/ Anna Van Sickles and William  Beaty. 

The couple was married in Bryan in 1881 (no month or day); nothing has been found in the marriage records.  Johannah stated in court that William was guilty of gross neglect.  On 15 Mar 1883 he choked and abused her.  He has been a habitual drunk for three years or more.  The case was dismissed.

William Beaty was first married to Mrs. Maria Shoemaker Wilson, widow of William Wilson, in Wms Co on 13 Apr 1847 (Marriage V2 p96). Maria, the daughter of Henry and Elizabeth Miller Shoemaker, was born in Stark Co, OH c Dec 1816.  Maria married William Wilson on 16 Apr 1837 in Stark Co, OH; he died bef 13 Apr 1847.

Early Williams County, OH Settlers - Thomas Ingram and Wife Elizabeth Lees

An Irishman, his wife, and their children came to the US in Nov 1830.  They initially settled in Wayne Co, OH but this early settler, his wife, and family eventually made their home in Florence Twp, Williams Co, OH c1844.  He was a carpenter and father of twelve children.  He began with 80 acres and later increased the size of his homestead so when he died, his estate provided this acreage to be passed down to his children and their descendants.  Anyone who is able to prove direct lineage to this family could be eligible for admission to the WCGS First Families of Williams Co, OH.  The deadline for application is April 15 with a welcome and formal acceptance at our End of the Year Banquet in June.  This pioneer is one example of hundreds who carved out a new life for himself and his kin.

Thomas Ingram was born in Wayne County, Ohio, November 17, 1833, the fifth child of twelve in the family of his parents, Thomas and Elizabeth (Lees) Ingram. His father was a carpenter by trade, and came to Williams County and entered land in 1840, moving his family here the year following, and encountering all the privations incident to pioneer life. At that time the country was an unbroken wilderness, and the howling of wolves was no unusual sound. They built a cabin for home, and here the father died June 28, 1852. Mr. Ingram has since resided on this farm. Consisting of 141 acres, and by his efforts he has acquired all the comforts and conveniences of modern life, with good buildings conducive to the happiness of his family. Mr. Ingram was married November 26, 1857, to Miss Magdalena Allman, of Williams County, and a family of nine children has blessed their union, viz., Ellwood, Margaret, John, Carrie, James, Susan, William, Bessie L. and Ellen. Mr. Ingram was a soldier in the war of the rebellion; he enlisted February 1865, and remained in the service until the close.

JOHN S. INGRAM -- On the first of September, 1919, John Sherman Ingram entered upon the discharge of his official duties as county recorder of Williams county, his election to this responsible post having taken place on the fifth of November of the preceding year, and the majority which he received in this election having emphatically attested to the high esteem in which he is held in his native county.

Mr. Ingram was born on his father's farm, in Florence Township, near the village of Edon, this county, and the date of his nativity was February 6, 1865. He is the son of James and Mary (Sheridan) Ingram, the former a native of County Antrim, Ireland, and the latter of the State of Pennsylvania. James Ingram was five years old at the time of the family immigration to the United States, and after remaining for a brief time in Wayne County, Ohio, his parents he settled on a farm in Florence Township [Thomas and Elizabeth (Lees) Ingram] came to Williams County, where his father engaged in farming and where both parents passed the remainder of their lives. James Ingram received his youthful education in the schools of this county and after his marriage he settled on a farm in Florence Township, where he long continued as a successful exponent of agricultural industry in the county and where he died when about seventy years of age, his wife also having passed away when seventy years of age. He was a Republican in politics and was affiliated with the Masonic fraternity. Of the five children three are living in 1920: James W., of Montpelier, this county; Harriet M., the wife of William Eddy, of Eaton Rapids, Michigan; and John S., of this review.

While looking at an old newspaper I stumbled on this article concerning a divorce action in Williams Co, OH concerning the wayward teacher and his wife.  If anyone has further info on the husband, Arthur C. Croninger, please email me.

Details from the Bryan Democrat, 2 Sept 1910, p1 c2:

The couple was married in Windsor (Essex), Ontario, Canada on 26 Oct 1908. Pearl charged that Arthur was guilty of extreme cruelty and gross neglect of duty.  She stated that her husband called her vile names and that since Dec 1909 he had “utterly failed to provide for her, and that prior to that time did not properly support her, although able to do so.”  Her petition stated that Arthur taught school at LaPorte, IN and received a good wage, but that he “squandered it in wild, riotous, scandalous and criminal living and neglected her.”  Presumably a divorce was granted. 

Pearl was 19 and Arthur was 21 when they married; both were residents of Bryan, Williams Co, OH.  Arthur was a student.

Article Summary: When a young white woman, Maud Rubel, was found dead in South Omaha, suspects included Sam Payne, an African-American who had lived in a building near the crime scene. In spite of conflicting eyewitness reports and the fact that Payne recanted his original confession, he was convicted. Racial beliefs of the day, expressed in newspaper articles, played a role in his sentencing. After ten years in prison the governor pardoned Payne.

18 Feb 1893 – Jurors in Omaha went on strike due to poor quality and quantity of food served to them as they were locked up and could not return to their homes to eat or sleep until the trial was over. Judge CR Scott agreed with the jurors that they should not be deliberating on half-full stomachs and the provisions of the Grand Central Hotel, which had the lowest bid and therefore was awarded the food and lodging of jurors by the county commissioners at 25 cents per each juror.  Lincoln Weekly News, 29 June 1893

17 Oct 1894 - Two judges in two different rooms tried the same case.  Judge CR Scott, a personal enemy of Edward Rosewater, editor of the Omaha Bee, insisted on trying the criminal libel suit of Sophia Bennett v Rosewater.  Later both judges involved dismissed the case.  NY Times, 18 Oct 1894

7 Nov 1895 – Judge CR Scott, the famous criminal judge, was returned to office of judge as a Republican candidate for the Omaha District Court even though he had been bitterly criticized by the lawyers and press of the area.  NY Times, 7 Nov 1895

16 Dec 1898 – Judge CR Scott decided an Omaha contempt case known as the Exposition Affair.  He lectured prominent men of the area for two hours and found them guilty of lawless acts.  He disbarred the Attorney Carroll Montgomery.  Scott called his fellow jurists “anarchists” and levied $30,000 in fines.  NY Times, 17 Dec 1898

28 Jan 1899, Charges were leveled in the form of impeachment proceedings against District Judge Cunningham R. Scott of Omaha.  Endorsed by the majority of the Omaha Bar, Speaker of the House of Nebraska Legislature, Mr. Clark, began the action citing “every shortcoming and abuse of power of which a judge could be accused.”  NY Times, 29 Jan 1899

A query came my way concerning the marriage and eventual divorce of Andrew Wesley Grice and Lucinda Huyck. They had a Williams County, Ohio connection but were neither married or divorced here (as no records have currently been uncovered).  I started with Familysearch to see if there were any records and found their son, Jacob, which I've included first, and then worked on what I could find on both the husband and wife.  As you will see, each went on to marry again and establish new lives.  I welcome any additional information to pass on to the originator of the query, who gave me a great deal of data on Lucinda.

Andrew was married second to Elizabeth Cornell, and she died NOV 1895 in Blissfield, Lenawee County, MI.  In a general affidavit by Elizabeth Holt of Blissfield, Lenawee County, MI, dated 20 MAR 1917, age 60, Elizabeth stated that when she was a little girl Andrew worked for her father for a number of years.  Elizabeth Cornell died 7 NOV 1895, and was buried in Blissfield.

Andrew died 3 DEC 1896 in the village of Blissfield, Lenawee County, Michigan, and was buried 6 DEC 1896.  He was associated with the M. E. Church of Blissfield.

In a general affidavit dated 23 JUL 1917 in Fort Collins, Larimer County, CO, Lucinda J. Miller, age 76 [born MAY 1841 per 1900 census], stated that she was the first wife of Andrew W. Grice, and that she was divorced on 24 OCT 1887 at Geneva, Kane County, Illinois.  Grounds for divorce was desertion.  Lucinda stated that she was married to Andrew in Morenci, Lenawee County, MI on 26 DEC 1855, and lived with Andrew until 24 OCT 1871.  Lucinda remarried H. [Henry] T. Miller on 28 SEP 1895.  Her maiden name was Lucinda Hych.

She died in 1918 in Ft. Collins and was buried there

More Trouble for Daniel Shellhart

Recently while researching something else, I stumbled on this newspaper account which gives further information on a divorce action I had written many years ago and can be found as an original post on this blog.  I have chosen to repost it here as well as add more information as I find it.

First, here is the newspaper article.

Bigamy

“Dan Shellhart is in trouble.  Dan used to live around here and did odd jobs for a living.  In 1873 he married Jane Priest, but the union was not the happiest one on record, and Dan left her and here some time ago.  Recently he was married again at Clyde, Ohio, and was soon afterward arrested for bigamy.  His examination was set for Nov 21 and Judge Perky was subpoenaed to appear with a certified copy of the marriage record, but was notified Wednesday morning that Shellhart had waived examination and was held for his appearance at the Sandusky County Common Pleas.  Dan’s wife Jane, supposing that he had left her for keeps, and feeling that it was unwise and unhealthy to live alone, accepted the hand and fortune of Joe Graham and they were married in August last.  So there are two cases of bigamy – one in Sandusky County and the other in Williams County, all connected by marriage”.

Second, here is a recap of the marriage, divorce, and bigamy actions concerning Daniel Shellhart.  I would note that the first sentence in the above article is definitely an understatement – “Dan Shellhart is in trouble” (again).

Untangling the Confusion on Kirtland Calvin

I recently received an email query on the ancestry of Kirtland Calvin.  The query asked whether this Kirtland, father of Zola Fay Calvin, was really born a Calvin or was he a Bohney?  I hope this information that I found is helpful and clears up the confusion of Kirtland Calvin’s parentage.  I would welcome any new data to pass along to the researcher.
