Amos Madison Case v Sarah M. Smith Case (Journal 7 p460 - Nov 1870; Roll 22 case number 29 - Aug 1870)

The couple was married on 22 Sept 1857 in Jefferson Co, NY. Amos Madison Case, the son of Wareham and Mercy Clark Case, was born on 8 Apr 1836 In Clayton, Jefferson Co, NY. In the 1850 Clayton, Jefferson Co, NY federal census p1, the Case family was listed as Wareham 62 MA, Mary 59 MA, and their children, including Madison 14 NY. In the 1860 Clayton, Jefferson Co, NY federal census p74 A. Madison Case is enumerated as 26 NY farmer and Sarah 22 NY living with Wareham and Mercy Case, natives of MA. Amos would go on to be a Civil War veteran. Sarah M Smith, the daughter of Isaac and Jane Smith, was born on 9 April 1838, Clayton, Jefferson Co, NY. She was listed with her parents in both the 1850 Clayton Federal Census as Sarah 12 NY and the 1855 NY State Census for Clayton as Sarah 16 NY.
Amos told the court that Sarah lived in Sherwood, Branch Co, MI as of 15 Apr 1867 when she abandoned him. He wanted a divorce; later Amos asked for the case to be dismissed. It would appear he neglected to mention that Amos and Sarah had a daughter Jennie who lived in 1870 Mattison, Branch Co, MI with her maternal grandmother and new step grandpa, Jane and James Davis. Jennie was born c1862 in NY.
There must have been a divorce as Sarah M Case, 36 of NY married Holton Kilbourne (1821-1901) on 20 January 1875 in Centerville, St Joseph Co, MI; both were residents of Sherwood, Branch Co, MI. In Sherwood, MI Jennie Case married Herbert L Cole on 6 October 1881 and they would become the parents of son, Charles Cole. According to the Battle Creek Enquirer (Battle Creek, MI), 19 June 1925 p15 c2 Sarah Kilbourne died on 16 June 1925 as one of the oldest residents of Sherwood, MI where she taught school for 20 years. She was survived by her grandson Charles Cole and sister Mrs Eliza Pierce of Holgate, OH
In the 1870 Bryan, Pulaski Twp, Wms Co, OH federal census p10, Madison Case 36 NY laborer was enumerated in the home of Anna Hill 39 PA dressmaker. On 1 Dec 1870, DeKalb Co, IN Amos married Maria Hester Sherlock and they had seven children. Maria, daughter of John O and Hannah C Truman Sherlock, was born on 22 Mar 1851 in England. The family was enumerated in both the 1880 and 1900 Auburn, DeKalb Co, IN Federal Census. Amos died on 18 Apr 1907 in Auburn, DeKalb Co, IN and was buried in Woodlawn Cemetery. His wife Maria died there in 1911.
